Terms and Conditions
Awfy Media aims to interact with its clients courteously, timely, and professionally.
The following terms and conditions will be accepted by clients that work with Awfy
Media:
The Contract
- Clients and Awfy Media will work as independent contractors; neither party
intends or implies any partnership or joint venture.
- Both parties will agree on a start date for the services, and fees will start to
accrue as of that time.
- The clients will receive a monthly performance services report.
- For some service responsibilities, Awfy Media retains the right to subcontract
a third-party service provider.
- No rights under or in connection with the Contract may be claimed by a third
party not a party to it.
Payment
- If customers choose one of Awfy Media's monthly service packages, they
must pay the full charged amount before the work can begin.
- The client must pay 50% of the billable amount up front before the work can
begin if our agency and the client agree on a fixed price for any services.
Within 7 days of the service start date, the remaining 50% of the money must
be made.
- Awfy Media will cancel the client's access to its services immediately if they
fail to pay a monthly invoice on the due date. In this situation, we won't be
required to give a 10-day warning.
Liability
- If obligated service deliverables are delayed for uncontrollable or natural
reasons, Awfy Media will not be liable for any indirect or consequential losses.
- The clients agree to defend, indemnify, and hold Awfy Media harmless from
and against any claims, losses, liabilities, and expenses arising from the
services rendered by Awfy Media to the clients according to this Agreement,
including without limitation any claims based on alleged false advertising,
liability claims for goods or services sold by the client, claims for patent,
copyright, or trademark infringement, and claims resulting from disruption or
malfunction of the client's systems.
- Any content or information provided by customers to Awfy Media for
publishing will be available to the public as soon as the publication is
completed due to the nature of digital media. Due to the content being
publicized, we shall not be liable for screening the material or for any losses in
profit, goodwill, or other company assets.
Waiver
- If we fail to insist that you strictly comply with any of your responsibilities
under a service contract or any of these terms and conditions at any point during the contract, this will not automatically release you from those
obligations and will not be construed as a waiver.
- Any waiver of a condition or term will only be regarded as legally binding if it is
made known to you in writing.
